Attempted fine from the tax authorities
In Kyiv, a man who put up a cap for UAH 350 on OLX almost received a fine of 15 thousand hryvnias. He arranged a meeting with the buyer, but instead of the client, representatives of the tax authorities were waiting for him.
What the court decided
The tax authorities tried to fine the seller for «illegal business activities». However, the court dismissed the case due to a lack of evidence and no evidence of systematic trading.
The position of a lawyer
The lawyer who commented on the incident said:
fines can indeed be imposed, but only in cases where a person systematically conducts business without registering as an individual entrepreneur;
one-off sales of personal items are not a violation.
Context.
Such audits have become more frequent recently. The tax authorities pay particular attention to those who actively trade through online platforms and earn regular income.
Conclusion.
Single sales on OLX or marketplaces do not entail fines. However, those who actually sell without a sole proprietorship should be careful - the tax authorities are tightening control.
