Territorial recruitment centres can take wanted persons right off the street without checking their documents. This was stated by MP Vadym Ivchenko, The court also noted the absence of any explanation or procedure during the detention.
How TCCs act when detaining wanted persons
Vadym Ivchenko said that the employees TCC have the right to detain wanted persons, even if they do not have documents. According to the MP, this means that identity checks are not mandatory, which raises concerns about the observance of citizens' rights.
Lack of explanations and documentary evidence
The MP stressed that the detainees are not provided with any explanations or documents confirming the grounds for detention. This creates situations where a person can be detained without the possibility to understand the reason or appeal against the actions of TCC employees.
Possible consequences for citizens
Experts believe that this practice can lead to violation of fundamental rights of citizens, including the right to defence and legal assistance. Failure to verify documents and explanations can lead to abuse and cases of unjustified detention.
Reaction of the public and legislators
After Vadym Ivchenko's statement, there were calls for a review of the work procedures of the MCC and the introduction of more transparent mechanisms for interaction with citizens. Representatives of human rights organisations emphasise the need to protect human rights even in the context of mobilisation and military registration.
