After reviewing the materials, the court granted the politician's appeal, returning her previously seized funds and cancelling the seizure of her husband's property.<\/p>\n<p data-start=\"540\" data-end=\"697\">The court re-established that, according to the court's findings, Tymoshenko did not transfer or receive any funds within the framework of the investigated episode.<\/p>\n<h3 data-start=\"699\" data-end=\"725\">Second appeal decision<\/h3>\n<p data-start=\"727\" data-end=\"859\">This is the second decision of the appellate instance to overturn the previous HACC ruling. During the previous review, the Appeals Chamber also<\/p>\n<ul data-start=\"861\" data-end=\"1005\">\n<li data-start=\"861\" data-end=\"923\">\n<p data-start=\"863\" data-end=\"923\">rejected the NABU prosecutor's request for a preventive measure;<\/p>\n<\/li>\n<li data-start=\"924\" data-end=\"960\">\n<p data-start=\"926\" data-end=\"960\">granted Tymoshenko's motion;<\/p>\n<\/li>\n<li data-start=\"961\" data-end=\"1005\">\n<p data-start=\"963\" data-end=\"1005\">lifted all restrictions on its movement.<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"1007\" data-end=\"1025\">Positions of the parties<\/h3>\n<p data-start=\"1027\" data-end=\"1217\">Tymoshenko herself stated that the criminal proceedings against her were of a political nature. According to her, law enforcement agencies are being used for political pressure instead of fighting corruption.<\/p>\n<p data-start=\"1219\" data-end=\"1328\">The official position of the NABU and the SAPO on the new decision of the Appeals Chamber has not been made public at the time of publication.<\/p>\n<h3 data-start=\"1330\" data-end=\"1342\">Context.<\/h3>\n<p data-start=\"1344\" data-end=\"1558\">The High Anti-Corruption Court considers cases related to grand corruption, and the decisions of its appellate chamber are final in criminal proceedings, unless further appeal to the Supreme Court is provided.<\/p>\n<p data-start=\"1560\" data-end=\"1761\" data-is-last-node=\"\" data-is-only-node=\"\">The cancellation of arrests and restrictions actually means restoring full access to the politician's assets and freedom of movement, but the criminal proceedings themselves may continue in other procedural
