From now on, the territorial recruitment and social support centres (TSCs) have the legal right to appeal in court against decisions establishing the fact of a father's independent upbringing of a child, if this decision becomes the basis for exemption from service or a deferment.<\/p>\n<h2 data-path-to-node=\"2\">Residence and notarial agreements are no longer an argument<\/h2>\n<p data-path-to-node=\"3\">The country's highest court has made it clear that the previous legal loopholes will no longer apply automatically. From now on, strict criteria have been set for obtaining the status of a \u00absingle parent\u00bb:<\/p>\n<ul data-path-to-node=\"4\">\n<li>\n<p data-path-to-node=\"4,0,0\"><b data-path-to-node=\"4,0,0\" data-index-in-node=\"0\">Living together does not prove sole care:<\/b> The mere fact that a child lives with his or her father is not a sufficient basis for recognising independent parenting.<\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"4,1,0\"><b data-path-to-node=\"4,1,0\" data-index-in-node=\"0\">Notarial agreements have lost their automatic effect:<\/b> Written agreements between parents on who the child stays with are no longer considered to be conclusive evidence for the court.<\/p>\n<\/li>\n<\/ul>\n<p data-path-to-node=\"5\">In order to make a decision in favour of a person liable for military service, it is now necessary to provide indisputable evidence. In particular, it must be proved that the child's mother is not actually involved in the child's upbringing at all, or that her parental rights or the real possibility of their exercise have been restricted or cancelled in accordance with the procedure established by law.<\/p>\n<h2 data-path-to-node=\"7\">Why can the TCC now intervene in court cases?<\/h2>\n<p data-path-to-node=\"8\">The main innovation of the court verdict is the recognition of the TCC as a full-fledged stakeholder in such civil proceedings.<\/p>\n<p data-path-to-node=\"9,0\"><b data-path-to-node=\"9,0\" data-index-in-node=\"0\">The court's position:<\/b> Since the establishment of the status of independent child-rearing directly affects the performance of military duty (emergence of legal grounds for deferment or discharge from military service), military commissariats have the full right to appeal and challenge such court decisions.<\/p>\n<p data-path-to-node=\"10\">Lawyers note that this decision is intended to close a widespread scheme <a href=\"https:\/\/ukrmedia.news\/suspilstvo\/sbu-skhemy-ukhylennia-mobilizatsiia\/\">evasion of mobilisation<\/a> through fictitious divorces and artificial placement of children under the care of their parents. Now, real single parents will have to collect a much wider package of evidence (certificates from educational institutions, housing inspection reports, testimonies of neighbours) to confirm their
