The sale of excisable goods is allowed only through licensed platforms that are included in a special state register. Buyers will be identified through the Diia portal or other modern technologies, and violations will result in website blocking and significant fines.<\/p>\n<div class=\"news-summary-box\">\n<div class=\"summary-title\">Briefly about the main points<\/div>\n<ul>\n<li>The law on the tax on digital platforms was extended to cover online sales of alcohol and tobacco.<\/li>\n<li>The sale of excisable goods is allowed only through platforms licensed and registered with the state.<\/li>\n<li>The identification of alcohol buyers will be carried out through Diya or face recognition technology.<\/li>\n<li>For violations, websites will be blocked and telecom providers will be fined up to UAH 68,000.<\/li>\n<\/ul>\n<\/div>\n<h2>Extension of the law on digital platforms to the alcohol market<\/h2>\n<p>The law on <a href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/4838-20#Text\" target=\"_blank\" rel=\"noopener\">tax on digital platforms<\/a> The Law was supplemented with provisions relating to the sale of alcohol, beer, tobacco and e-cigarettes. From now on, e-commerce in such excisable goods is only possible if a valid licence is obtained and the platform is entered in the state register. The register must include the websites, URLs, domain names and mobile applications through which the sales are made.<\/p>\n<h2>Control mechanisms for online sales<\/h2>\n<p>The State Tax Service (STS) has been empowered to restrict access to platforms that sell alcohol or tobacco without proper registration. If a platform is not listed in the register, the STS may decide to block it, which is implemented by the National Centre for Operational and Technical Management. Electronic communications providers are obliged to implement the blocking within three business days.<\/p>\n<h2>Mandatory identification of customers<\/h2>\n<p>The sale of alcohol and tobacco products online is possible only after the age of the buyer has been identified. The law requires the use of data from an electronic passport, driver's licence via Diia, as well as face recognition technology or remote identification with an operator in real time. This should prevent sales to minors.<\/p>\n<h2>Penalties for violations<\/h2>\n<p>Failure to comply with the obligation to block illegal platforms is punishable by a fine of 2,000 tax-free minimum incomes (UAH 34,000), and a repeat offence is punishable by a fine of 4,000 minimum incomes (UAH 68,000). Selling without a licence entails the cancellation of permits and blocking of resources, and the regulator's decisions are binding.<\/p>\n<h2>Tax control and reporting of platform operators<\/h2>\n<p>The law tightens the requirements for digital platform operators to report user income. The absence or submission of inaccurate information will result in a fine of 20 minimum wages, which is about UAH 160,000. The law also legalises the model of cooperation between platform operators and sellers of personal services without the risk of reclassifying their relations as labour.<\/p>\n<h2>Rejected proposals and hidden regulations<\/h2>\n<p>The vast majority of more than 3,500 amendments to the draft law were rejected. In particular, the threshold for tax-exempt transactions was not raised, the timing of the law's launch was not changed, and fixed fines were retained. The draft law introduced a provision on an export duty on stones that will be valid for 10 years, and strengthened control over the illegal sale of excisable goods via the
