Administrative fines are set to increase tenfold, and legal entities will face criminal liability for the first time. The bills also provide for the personal liability of local government officials for failure to act.<\/p>\n<div class=\"news-summary-box\">\n<div class=\"summary-title\">Briefly about the main points<\/div>\n<ul>\n<li>The Cabinet of Ministers has submitted two draft laws on waste management to parliament.<\/li>\n<li>Administrative fines are rising from hundreds to tens of thousands of hryvnias.<\/li>\n<li>Local government officials are held personally accountable.<\/li>\n<li>Legal entities may, for the first time, be held criminally liable.<\/li>\n<li>The distinction between administrative and criminal liability is based on a threshold of 166,400 UAH.<\/li>\n<\/ul>\n<\/div>\n<h2>Tightening of administrative liability for waste management offences<\/h2>\n<p>Draft Law of Ukraine <a href=\"https:\/\/itd.rada.gov.ua\/billinfo\/Bills\/Card\/70198\" target=\"_blank\" rel=\"noopener\">No. 15325<\/a> significantly increases the level of administrative fines for offences relating to waste management. From now on, fines for land degradation, littering in forests and breaches of waste management regulations will rise from a few hundred hryvnias to tens of thousands. In addition, failure to submit a declaration and the absence of a waste management plan are now classified as separate administrative offences.<\/p>\n<p>The new regulations also introduce personal liability for local government officials for failure to act on the issue of unauthorised rubbish dumps. This means that officials will now be held accountable for negligence in environmental matters.<\/p>\n<h2>Criminal liability for legal entities<\/h2>\n<p>Draft Bill <a href=\"https:\/\/itd.rada.gov.ua\/billinfo\/Bills\/Card\/70202\" target=\"_blank\" rel=\"noopener\">No. 15327<\/a> introduces criminal liability for offences relating to waste management, which is a new development for legal entities. This draft legislation sets the threshold for criminal liability for causing significant harm at 166,400 hryvnias.<\/p>\n<p>Thanks to this project, legal entities, including businesses and organisations, may be held criminally liable for serious offences affecting the environment.<\/p>\n<h2>A single scale of liability for waste-related offences<\/h2>\n<p>Both draft laws establish a single scale of liability, with the distinction between administrative and criminal liability set at 166,400 hryvnias. Offences causing \u00absignificant harm\u00bb are punishable by administrative penalties, whilst cases of \u00absubstantial harm\u00bb are subject to criminal prosecution.<\/p>\n<p>This far-reaching reform aims to increase the liability of both individuals and legal entities for breaches of environmental legislation, whilst strengthening oversight of waste management in
