It gives the Russian authorities grounds to intervene in the operations and management of businesses if their owners have failed to provide adequate protection against drone attacks, have been slow to implement security measures, or have delayed the repair of damaged facilities. For businesses, this creates the risk of losing effective control over their assets.<\/p>\n<div class=\"news-summary-box\">\n<p><strong>Briefly about the main points<\/strong><\/p>\n<ul>\n<li>The special measures relate to critical infrastructure in the Russian Federation.<\/li>\n<li>This may be due to delayed or inadequate protection against UAVs.<\/li>\n<li>The rate of recovery from injuries will be taken into account separately.<\/li>\n<li>The decree does not provide for the automatic revocation of a business\u2019s licence following each attack.<\/li>\n<li>Owners will bear both financial and management risks.<\/li>\n<\/ul>\n<\/div>\n<h2>What breaches could give rise to enforcement measures?<\/h2>\n<p>The document is entitled \u00abOn measures to ensure the security of critical infrastructure facilities in the Russian Federation\u00bb. It explicitly states that special measures may be applied if the owner has failed to implement security measures or has done so too late.<\/p>\n<p>The ineffectiveness of measures to counter the threat of attacks using unmanned aerial vehicles has been cited as a separate ground. The authorities will also be able to take into account whether operations at the facility were resumed in a timely manner following damage. The assessment of the adequacy of protection and the pace of repairs will, in practice, depend on the decision of the Russian state authorities.<\/p>\n<h2>Who is affected by the rules and what does \u2018interference\u2019 mean?<\/h2>\n<p>The new regulations are aimed at companies that own or operate critical infrastructure. Such facilities include energy, industrial, transport and logistics enterprises.<\/p>\n<p>In the event of non-compliance, the state has the means to exert influence over the entity\u2019s operations and its management. For the owner, this could result in the loss of effective control over the enterprise if the authorities deem the safeguards to be insufficient or the recovery process to be too slow.<\/p>\n<p>The decree does not provide for <strong>the automatic removal of any private asset following each drone strike<\/strong>. This concerns critical enterprises and the authorities\u2019 decisions as to whether they have met the specified requirements.<\/p>\n<h2>The decree was issued following an intensification of Ukrainian attacks<\/h2>\n<p>The decision was taken against the backdrop of a rise in the number of Ukrainians <a href=\"https:\/\/ukrmedia.news\/en\/main-news\/dalekobiini-udary-ukrainy-po-rosii\/\">long-range strikes<\/a> on Russia\u2019s industrial, fuel, military and logistics infrastructure. In recent days, there have been reports of major fires at Ozon logistics centres, warehouses, military bases, oil refineries and energy facilities in various regions of the Russian Federation.<\/p>\n<p>19 August <strong>Putin<\/strong> acknowledged that Ukrainian attacks are causing damage to the Russian economy, whilst stating that there were no \u00abcritical consequences\u00bb. He called for the strengthening of air defence and coordination between state bodies, and for the involvement of the private sector in protecting facilities; he also spoke of the restoration of damaged storage and logistics facilities with state support.<\/p>\n<p>Infrastructure problems have already had an impact on the fuel market. The Russian Deputy Prime Minister <strong>Alexander Novak<\/strong> In July, it was reported that petrol and diesel production had been temporarily reduced following damage to several refineries; in response, the government increased capacity utilisation at other refineries, redirected stocks to the domestic market and introduced export restrictions.<\/p>\n<h2>Defence costs are now linked to the risk of claims<\/h2>\n<p>Russian companies are already spending money on anti-drone nets, electronic countermeasures, UAV detection systems and physical protection for storage tanks and equipment. This problem is most acute for oil refineries, oil depots, warehouses, logistics centres and large industrial enterprises.<\/p>\n<p>Previously, business leaders had called for the private sector to be allowed to use more powerful measures to counter drones. In March, the Russian Federation authorised private security firms to use firearms to protect critical energy infrastructure, and in May, private companies were given the go-ahead to purchase certain anti-UAV equipment.<\/p>\n<p>Now, business owners risk not only suffering losses as a result of an attack and having to pay for security and repairs.
