One partner creates an application, the other confirms it in their app, after which the details are checked against the State Register of Civil Status Acts. State registration takes place after a set waiting period.

Briefly about the main points

You can file for divorce via the Diya app.

Both partners must confirm and sign the declaration.

The divorce is finalised after about a month.

You are permitted to withdraw your application before the video conference.

Couples with joint minor children need to apply to the court.

How to apply and go through the vetting process

The initiator creates application in Dii and selects the date and time for the video recording. The other spouse receives a request: they complete their section, confirm the selected time and sign the application remotely using Diya.Sign. Without this, the online process cannot continue.

Once confirmed, the system cross-checks the details against the civil status register. Applicants must complete the data entry within 48 hours of selecting a time slot. A Civil Registry Office employee checks the application and the register data within five working days, after which they either confirm the appointment time or send a reasoned refusal via the app.

Registration deadline and the option to withdraw an application

Once an application has been submitted, there is a statutory period within which the decision may be amended. The minimum period until state registration is one month and two calendar days from the date selected; therefore, in practice, the procedure takes around a month.

If the couple decide not to end their marriage, statement It can be cancelled no later than four hours before the scheduled video conference. During the video conference, a staff member of the Civil Registry Office verifies that the parties are giving their free and informed consent, after which they sign the electronic record of the proceedings.

If any of the applicants or a member of staff at the Civil Registry Office fails to join the video conference within 15 minutes, or if a technical issue is not resolved within that time, the couple may choose the next available slot on the same day without having to pay the fee or the Civil Registry Office’s service charge again.

Who the online procedure is not suitable for

Where there are joint minor children, the marriage is still dissolved through the courts. Similarly, it is not possible to arrange a unilateral divorce via ‘Diyu’: the lack of consent from one of the partners makes it impossible to use the service.

During the beta testing phase, the requirements also included being of legal age, Ukrainian citizenship, a verified RNOKPP, a document in ‘Dii’, and a marriage record listed in the register. The system will not allow the application to be completed if, for example, there is no marriage record or if the record already indicates that the marriage has been dissolved.

In-person visits to the Civil Registry Office remain available

The online service does not replace the usual procedure. Those who do not use Diya or do not wish to complete the process remotely may visit the Civil Registry Office in person.

Previously, the standard procedure involved paper applications and in-person visits. The new service moves the main stages onto a smartphone, whilst maintaining registration checks through data verification and video conferencing. It was developed by the Ministry of Digital Transformation in collaboration with the Ministry of Justice, the State Enterprise «National Information Systems», the Digital Civil Registry Office, the State Migration Service and Ukrposhta, with the support of the EGAP programme.

To get a divorce via Diia, one spouse submits an application, whilst the other confirms it via Diia by signing and approving the video recording.

Для розлучення через Дію один із подружжя створює заяву, а другий підтверджує її Дія.Підписом і погоджує відеореєстрацію.
[806817
806775
post-28509","post","type-post","status-publish","format-standard","has-post-thumbnail","category-vazhlyvo-znaty","tag-806775
["GET
