The rules on job retention apply to those liable for military service; therefore, the decisive factors are their registration category, the grounds for their registration and any entitlement to a special deferral.<\/p>\n<div class=\"news-summary-box\">\n<p><strong>Briefly about the main points<\/strong><\/p>\n<ul>\n<li>Reserve status may preclude booking a job placement.<\/li>\n<li>\u00abReserve+\u00bb displays data from the \u00abOberig\u00bb register, but does not determine the status itself.<\/li>\n<li>The court stated that a first-tier reservist is not subject to conscription.<\/li>\n<li>Persons with a valid deferral shall not be included in the reserve without a written refusal.<\/li>\n<li>You can check the status and reasons for the entry via the TCC or the data correction service.<\/li>\n<\/ul>\n<\/div>\n<h2>How does the operational reserve status affect bookings?<\/h2>\n<p>The inclusion of citizens discharged from service in the operational reserve during a special period is governed by <a href=\"https:\/\/protocol.ua\/ua\/pro_viyskoviy_obov_yazok_i_viyskovu_slugbu_stattya_26_2\/\" target=\"_blank\" rel=\"noopener\">Article 26-2 of the Law \u00abOn Military Duty and Military Service\u00bb<\/a>. Individuals who meet the health and professional-psychological criteria may be classified in this category.<\/p>\n<p><a href=\"https:\/\/protocol.ua\/ua\/pro_mobilizatsiynu_pidgotovku_ta_mobilizatsiyu_stattya_25\/\" target=\"_blank\" rel=\"noopener\">Article 25 of the Law \u00abOn Mobilisation Preparedness and Mobilisation\u00bb<\/a> provides for the retention of persons liable for military service who work in specified institutions or at enterprises. Membership of the operational reserve changes a person\u2019s initial status: they are regarded as a reservist rather than as a person liable for military service, which prevents their retention under the general rules.<\/p>\n<p>In its judgment of 24 April 2026 in Case No. 440\/4299\/25, the Second Administrative Court of Appeal noted that a person in the first tier of the operational reserve is not subject to <a href=\"https:\/\/ukrmedia.news\/en\/suspilstvo\/u-radi-hotujut-zminy-do-bronjuvannja\/\">booking<\/a> precisely because of their reservist status. The Defence Forces also attribute the possibility of re-enlisting a discharged serviceman to the absence of such status.<\/p>\n<p>If a person has been included in the operational reserve, it is not possible to make a standard booking on the basis of employment. The status itself <a href=\"https:\/\/ukrmedia.news\/en\/suspilstvo\/nktsfr-krytychno-vazhlivi-pidpryiemstva\/\">a business of critical importance<\/a> This is not sufficient for the employer in such a case. If a discharged military personnel member has not been enrolled in the reserve, their application is considered in the standard manner: the post is assessed, as well as the company\u2019s criticality and other legal restrictions.<\/p>\n<p>Cabinet of Ministers Resolution No. 768 of 12 June 2026 established a special rule for certain individuals discharged from service with a deferral: whilst the deferral is in force, they may not be enrolled in the operational reserve. An exception may be made if the individual has personally waived the deferral in writing.<\/p>\n<h2>How to check and update your account details<\/h2>\n<p>The \u00abRezerv+\u00bb app is an online portal that displays information from the \u00abOberig\u00bb Unified State Register of Conscripts, Persons Liable for Military Service and Reservists. An entry in the app does not in itself create or revoke a person\u2019s legal status.<\/p>\n<p>According to the Ministry of Defence\u2019s clarification, the notation \u00abRemoved from the register\u00bb in an electronic document may refer to a transfer to the operational reserve. It should not be equated with the status \u00abExcluded from the register\u00bb. In \u00abReserve+\u00bb, you should check your registration category, as well as details regarding any deferrals or postponements.<\/p>\n<p>If the status is \u00abDeregistered\u00bb, please contact <a href=\"https:\/\/ukrmedia.news\/en\/vazhlyvo-znaty\/pravila-tck-policiyi-zatrimannya\/\">TCC<\/a>, to ascertain the basis for the entry in \u00abOberig\u00bb and the actual status regarding the operational reserve. The data can be corrected via the online service within the app or by submitting a personal application to the TCC, after which a new electronic document must be generated.<\/p>\n<p>To substantiate your case, it is advisable to keep paper copies of orders and certificates relating to dismissal, the granting of a deferment or enrolment in the reserve.<\/p>","protected":false},"excerpt":{"rendered":"<p>A discharged serviceman may be reserved in accordance with the general rules, provided he has not been assigned to the operational reserve.
