The government wishes to review the criteria for classifying enterprises as critical and to reach an agreement with the business community on the voluntary recruitment of employees into the armed forces in exchange for the possibility of full exemption. At the same time, according to a forecast by Prime Minister Serhiy Koretskyi, approximately 90–95% employees of energy and defence enterprises will be eligible for renewed exemption.

Briefly about the main points

By 1 December, the government and the business sector must develop a new model for mobilisation and recruitment.

The criticality of enterprises will be separated from economic indicators, in particular wages and tax compliance.

According to the Prime Minister’s forecast, around 90–95% workers in the energy and defence sectors will have their bookings renewed.

There are plans to reduce the maximum booking level for critical enterprises from 100% to 95%, with the possibility of exceptions.

Businesses may be permitted to make full bookings provided they fulfil voluntary mobilisation obligations.

What will change in the staff booking system

Prime Minister Sergey Koretsky stated that the current system booking allows individual companies to be granted ‘critically important’ status, primarily on the basis of high salaries and the absence of tax arrears. According to the Prime Minister, these indicators do not always reflect the true significance of a company for the country’s defence and vital functions.

The Government proposes that priority be given to the operations of enterprises in strategic sectors. These include the energy sector, the defence industry, telecommunications, housing and communal services, food production, the pharmaceutical industry and logistics.

Koretsky also highlighted cases where companies with only a small volume of defence production are able to reserve hundreds of employees. According to him, the government intends to step up inspections of such companies and reduce the number of unjustified reservations.

At the same time, there are no plans to abolish the economic criteria entirely. The authorities wish to separate them from the assessment of how vital enterprises are to the state.

Who will be reassigned following the introduction of the new rules?

According to the Prime Minister’s forecast, the vast majority of workers in the fuel and energy and defence industries will retain the right to receive a quota following the review of the system.

On 23 October, the government announced that draft amendments, which provide for a reduction in the standard maximum booking level from 100% to 95% for certain critical enterprises.

However, companies that need to retain a larger proportion of their staff to ensure business continuity will be able to apply to a special Coordination Centre, providing appropriate justification.

Consequently, the limit of 95% does not entail the automatic cancellation of all employees’ bookings in excess of this limit without taking the company’s needs into account.

Businesses are being offered a new model for mobilisation obligations

One of the key aspects of the forthcoming reform is the possibility of fully reserving personnel, provided that enterprises participate in the planned replenishment of the Armed Forces of Ukraine.

Under the government’s plan, the company could retain its employees whilst regularly ensuring that some of its staff volunteer for military service.

The Prime Minister described this approach as a new social contract between the state, the business sector and citizens. He emphasised that the future system must ensure the replenishment of the armed forces and the possibility of rotating serving military personnel.

The government is also proposing to establish clear terms of service for employees who volunteer to join the armed forces. In particular, individuals must be informed in advance of the location and duration of their service, and their job and salary must be guaranteed whilst they are serving.

At present, the specific mechanism for such commitments has not yet been approved. It is to be drawn up by the Ministry of Defence, the Ministry of the Economy and representatives of the business community.

Why do they want to have the new rules ready by 1 December?

Koretsky explained that the changes were necessary due to the increase in the number of conscripts on standby and the need to ensure the rotation of personnel who have been on the front line for a long time.

The Prime Minister also drew attention to the possibility of an intensified mobilisation in Russia. In his assessment, Russia could potentially mobilise a further 300,000–500,000 people. This is a projected scenario, not an announcement of a decision already taken by the Russian authorities.

The Prime Minister emphasised that the state must prepare in advance for possible changes in the military situation, so as to avoid having to introduce new restrictions at short notice.

The Cabinet of Ministers plans to present an agreed model for mobilisation obligations by 1 December. Before doing so, the government is to hold further consultations with representatives of businesses and business associations.

That said, Koretsky had previously emphasised that the preparation of the new system does not mean an immediate intensification of mobilisation. The final terms and conditions for reserving places will depend on the regulatory decisions taken.
