Ukraine may introduce up to 10 years in prison for threatening officials online<\/h2>\n

Ukraine has registered a draft law to increase criminal liability for threats to civil servants, MPs and public figures<\/strong>, including on the Internet. The document provides for significant changes to Article 346 of the Criminal Code of Ukraine<\/strong>.<\/p>\n

What is proposed to be changed<\/h3>\n

According to the draft law, liability is established for:<\/p>\n

Threats to officials<\/h4>\n

Threats murder, violence, harm to health, abduction, destruction of property<\/strong> or imprisonment, are expressed:<\/p>\n

    orally or in writing<\/p>\n<\/li>\n

  • \n

    via the Internet or by means of communication<\/p>\n<\/li>\n

  • \n

    through photos, videos or demonstrations of weapons<\/p>\n<\/li>\n<\/ul>\n

    in relation to senior state officials, heads of government agencies, judges, law enforcement officers, politicians<\/strong>, as well as their close relatives shall be punishable by imprisonment for a term of 5 to 8 years<\/strong>.<\/p>\n

    Calls for violence<\/h4>\n

    Public appeals or incitement<\/strong> to murder, violence, theft or destruction of property against officials, including:<\/p>\n

      via social media<\/p>\n<\/li>\n

    • \n

      comments<\/p>\n<\/li>\n

    • \n

      Distribution or endorsement of such materials<\/p>\n<\/li>\n<\/ul>\n

      - provide for imprisonment from 6 to 10 years<\/strong>.<\/p>\n

      Physical violence<\/h4>\n

      • \n

        Beatings, light and moderate bodily harm<\/strong>, committed in connection with state or public activities 7-10 years in prison<\/strong>.<\/p>\n<\/li>\n

      • \n

        Serious bodily injury<\/strong> - 10-15 years in prison<\/strong>.<\/p>\n<\/li>\n<\/ul>\n

        The most severe punishment<\/h3>\n

        If such actions:<\/p>\n

          \n
        • \n

          committed during martial law<\/strong><\/p>\n<\/li>\n

        • \n

          realised repeatedly or by a group of persons<\/strong><\/p>\n<\/li>\n

        • \n

          accompanied by use of weapons and explosives<\/strong><\/p>\n<\/li>\n

        • \n

          have political motives or mass distribution through information technology<\/strong><\/p>\n<\/li>\n<\/ul>\n

          - The draft law provides for 10 to 15 years' imprisonment or life imprisonment<\/strong>.<\/p>\n

          Context.<\/h3>\n

          The initiators of the draft law state that the document is aimed at Protection of state institutions and officials<\/strong> in a time of war, when threats and calls for violence are increasingly spread through social media and messengers.<\/p>\n
