TCC fines can be transferred to enforcers within 15 days

If during the 15 days the territorial recruitment centre does not receive information about payment of a fine or appealing against it in court, the TCC is entitled to submit the resolution to the executive service for enforcement. This was reported by the Kyiv Regional TCC.

What happens after the case is transferred to the bailiffs

After the opening of enforcement proceedings the amount of the fine actually increases, because the enforcement fee and the costs of the proceedings are added. As a result, the total payment may be doubled.

In addition, state bailiffs are authorised to promptly seize bank accounts, property and restrict the right to drive, This significantly complicates the debtor's financial operations.

What is the impact of going to court

Filing a lawsuit in court within 10 days from the moment of receipt of the decision, suspends the 15-day payment period until the final decision is made.

At the same time, the very fact of going to court does not automatically block the seizure of accounts. In order to avoid financial restrictions during the case, you must submit separate motion.

Context.

The issue of fines, mobilisation procedures and the powers of the executive service remains one of the most sensitive in society during a full-scale war.

Lawyers advise to keep a close eye on the deadlines for payment and appeal, because Delinquency quickly leads to foreclosure and financial restrictions.
