Appeal overturns Anti-Corruption Court's decision in Yulia Tymoshenko case for the second time

Appeals Chamber High Anti-Corruption Court repeatedly cancelled the decision of the first instance court in the case of the leader of the Batkivshchyna party« Yulia Tymoshenko. After reviewing the materials, the court granted the politician's appeal, returning her previously seized funds and cancelling the seizure of her husband's property.

The court re-established that, according to the court's findings, Tymoshenko did not transfer or receive any funds within the framework of the investigated episode.

Second appeal decision

This is the second decision of the appellate instance to overturn the previous HACC ruling. During the previous review, the Appeals Chamber also

  • rejected the NABU prosecutor's request for a preventive measure;

  • granted Tymoshenko's motion;

  • lifted all restrictions on its movement.

Positions of the parties

Tymoshenko herself stated that the criminal proceedings against her were of a political nature. According to her, law enforcement agencies are being used for political pressure instead of fighting corruption.

The official position of the NABU and the SAPO on the new decision of the Appeals Chamber has not been made public at the time of publication.

Context.

The High Anti-Corruption Court considers cases related to grand corruption, and the decisions of its appellate chamber are final in criminal proceedings, unless further appeal to the Supreme Court is provided.

The cancellation of arrests and restrictions actually means restoring full access to the politician's assets and freedom of movement, but the criminal proceedings themselves may continue in other procedural forms.
