Legislative initiative against «busking» in Ukraine
The Verkhovna Rada has registered a draft law that proposes to criminalise the forced detention of people in territorial recruitment centres (TCC), assembly points and military units without legal grounds. The draft law establishes liability for prolonged detention of citizens beyond the established time limits and for restricting their communications, including the forced seizure of mobile phones.
Sanctions and penalties for violations
Forcible detention of persons without legal grounds, as well as restriction of communication, is punishable by imprisonment for 5 to 7 years. For those in charge who issue knowingly unlawful orders that lead to unlawful detention, the draft law establishes a prison sentence of 5 to 8 years.
Aggravating circumstances and maximum sentences
If the acts are committed by a group of persons, involve several people, minors, or are accompanied by violence, humiliation or ill-treatment, the penalty is up to 12 years' imprisonment. These norms take into account the special social danger of such actions and are aimed at protecting the rights of servicemen and women.
Public reaction and further steps
The draft law should become a tool for preventing violations of the rights of mobilised persons and the military. Its adoption could significantly complicate the practice of forced detention and ill-treatment in military institutions. The next stage will be consideration of the draft law by parliamentary committees and voting in the Verkhovna Rada.
